Proposal to revoke the DFSV Code of Practice - Consultation

Consultation on a proposal to revoke the DFSV Code of Practice for dairy food safety 2002

The DFSV Code of Practice for dairy food safety 2002 was approved in September 2002 and outlines the framework for regulation of food safety in the Victorian dairy industry

Major changes have occurred in the food regulatory landscape since 2002.

A recent review of regulatory requirements found that in addition to the Code of Practice referencing out of date and superseded requirements, all regulatory requirements currently outlined in the Code of Practice duplicate requirements in legislation. Specifically many of the requirements of the Code of Practice are now covered by the Australia New Zealand Food Standards Code through the introduction in 2008 of Standard 4.2.4 – Primary Production and Processing Standard for Dairy Products.

On this basis DFSV considers that the Code of Practice is unnecessary and proposes to revoke the Code of Practice. In line with Victorian Government policy the aim is to remove unnecessary regulatory duplication.

As required by section 32(2) of the Dairy Act 2000 notice of the proposal to revoke the Code of Practice was published in the Government Gazette on Thursday 4 May 2017.

A Discussion Paper outlining the reasoning for the proposal to revoke the Code of Practice can be found here and a copy of the Section 32(2) Notice and the proposed instrument revoking the Code may be viewed here.
